MINIMUM TECHNICAL REQUIREMENTS

This guide provides basic information about the minimum technical requirements. For more information, please contact HITRO.HR STAFF at the Financial Agency (FINA) or the competent County State Administration Offices (Departments of Economics) and in Zagreb, the Office of Economics of the City of Zagreb (herein: Economics Offices).

In this guide we have outlined the procedure and documents required for obtaining the Certificate of Compliance with the Minimum Technical Requirements.

What are minimum technical requirements? Before starting-up, companies and craft businesses registered for hospitality, commercial, tourist and transport activities must obtain a certificate from the competent Economics Office, confirming that the facilities and equipment meet the requirements prescribed for the respective activity.

STEP ONE

After you have registered your company into the Commercial Court Registry or your craft into the Craft Registry and you wish to perform hospitality, commercial, tourist or transport activities, you must obtain a Certificate of Compliance with the Minimum Technical and Other Requirements for the Performance of Economic Activities from the competent body.

The bodies competent for determining minimum technical requirements are County State Administration Offices (town branch offices) and for Zagreb, the Office of Economics of the City of Zagreb.

STEP TWO

After you have located the competent office and found out the fees you have to pay for the selected activity, the following step is to obtain all the necessary documentation for the activity which you wish to perform and the premises depending on their purpose.

All required payments can be made at HITRO.HR offices.

You need

a. Application form + administrative fees (buy at Official Gazette, FINA)

b. Commercial Court Resolution on Entry in the Court Registry (for legal entities) or Resolution on Entry in the Registry of Craft Businesses (for natural persons).

c. Evidence of the right of disposition over the premises::

  1. Lease agreement
  2. Title deed

d. Evidence that the premises fulfil the prescribed conditions for business premises pursuant to the Building and Construction Act::

  1. Use permit
  2. Building permit (final until 31 December 2003)
  3. Certificate from the competent town's Cadastre and Geodetic Office for buildings constructed before 15 February 1968 (plan of the current construction and position)

e. Evidence of education degree:

  1. Secondary school diploma
  2. Certificate of professional qualifications for hospitality and for travel agency activities/branch manager (as well as for other legally prescribed activities)

 Certificates of compliance:

  1. Clearance from power supply authority (evidence of proper functioning of electric installations)
  2. Ventilation system effectiveness test report
  3. Clearance from sanitary inspectorate regarding noise protection (issued by sanitary inspector)
  4. Air pollution and hazardous emissions report for food preparation facilities
  5. A water report attesting to or certifying the potability of water for the start-up hospitality facilities or for those out of business for more than 6 months
  6. Certificate of Tightness for sewage and plumbing installations for start-up facilities
  7. Certificate of Tightness of septic tanks for facilities located in the areas not connected to the sewage network
  8. Expected turnover plan for a three-year period (only for start-up travel agencies). agencies starting a trip organizing business).

STEP THREE

After you have gathered all necessary documentation, the filled out application, together with all certificates and reports attached, should be submitted to the Minimum Technical Requirements Division, including paid fees

The Division will appoint a procedure manager who will establish an expert commission to perform onsite inspection and verify the minimum requirements.

The statutory term for issuing the Certificate of Compliance with the Minimum Technical Requirements for duly submitted applications is 15 days. The facilities concerned can be put into operation immediately upon the receipt of the certificate.
